The terms ‘we’, ‘us’, ‘our’ and ‘the Studio’ refer to Kasbah Creative / Bahia Saïdi EI.
The customer refers to any professional or capable natural person within the meaning of Articles 1123 et seq. of the Civil Code, or legal entity, who visits the Site which is the subject of these terms and conditions.

The purpose of the https://www.kasbahcreative.studio website is to provide information about all of the company's activities. The studio endeavours to provide information on the https://www.kasbahcreative.studio website that is as accurate as possible. However, it cannot be held responsible for any omissions, inaccuracies or failures to update information, whether these are its fault or the fault of third-party partners who provide it with this information.

The Studio specialises in art direction, brand identity, print and digital design, web design, community management, space planning and interior design.

Our prices are quoted in euros, inclusive of all taxes. VAT is not applicable in accordance with article 293 B of the General Tax Code.
The Studio reserves the right to change its prices at any time. The service will be invoiced on the basis of the tariff in force at the time the quotation is signed.
The various elements that may be required to carry out the Studio's services and that are not included in our offers are not included in the prices indicated. These include: fonts, photographs or illustrations from image banks. If necessary, their cost will be indicated to the Customer and then added to the invoice.

Payment shall be made by bank transfer no later than 30 days after the invoice date. Beyond this date, any delay in payment may give rise to penalties at the rate of 10% of the total invoice for each month of delay.
This penalty is calculated on the amount, including all taxes, of the remaining sum due, and runs from the due date of the invoice without any prior formal notice being necessary. The Studio's bank details are given to the Customer on the invoice.
In the event of exceptional cancellation of the project, the invoice issued will be calculated pro rata to the work carried out.

The work carried out for the Customer remains the property of the Studio as long as the invoices issued have not been paid in full. The files will be supplied once final payment has been received.
Unless otherwise stated in the contract, production files and source files remain the property of the Studio. Only the finished product will be sent to the Customer. The Studio is not obliged to make the source files available to the Customer, but only the result of its work in a form that can be used by professionals in the sector concerned.

Reproduction and distribution rights will be transferred to the Customer in accordance with the conditions set out in the contract.
The work carried out as part of the project remains the property of the Studio until the invoices issued have been paid in full.
The moral rights of a creation (including, among other things, the right to respect for the work and the right to respect for the name) nevertheless remain attached to its author in perpetuity. Any alteration or transformation of the visuals created and delivered without the Studio's consent is prohibited. Any representation or reproduction in whole or in part made without the consent of the author or his successors in title is unlawful, and punishable under the laws relating to the offence of counterfeiting. The same applies to translation, adaptation or transformation, arrangement or reproduction by any art or process whatsoever (art. L. 122-4 of the CPI).
The Studio reserves the right to mention and publish its work for the Customer as part of its external communication and advertising initiatives, on its website and on its social medias.

Bahia Saïdi EI is the owner of the intellectual property rights or holds the rights of use on all the elements accessible on the site, in particular the texts, images, graphics, logos, icons, sounds, software as well as the name ‘Kasbah Creative’, whether they are registered or not.
Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or process used, is prohibited and will be prosecuted, except with the prior written authorisation of Bahia Saïdi EI.

In France, personal data is protected in particular by law no. 78-87 of 6 January 1978, law no. 2004-801 of 6 August 2004, article L. 226-13 of the Criminal Code and the European Directive of 24 October 1995, as well as by the RGPD.
The studio collects personal information relating to the user via contact forms. The user provides this information with full knowledge of the facts. In particular, this information will be used to issue quotes and invoices.
No email address or personal data will be passed on to third parties or partners, except with the written consent of the parties concerned.
